Section 1 - What do we do with your information?

When you buy something in our store, as part of the buying and selling process, we collect the personal data you give us, such as name, address and email address.

When you browse our store, we also automatically receive your computer's IP address to provide us with information about your browser and operating system.

Email marketing

With your consent, we may send you emails about our store, new products and other updates.

Section 2 - Consent

How do you obtain my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange delivery or return a purchase, we assume that you consent to us collecting that information and using it only for that specific purpose.

If we ask for your personal data for other purposes, such as for marketing purposes, we will either ask you directly for your express consent or give you the opportunity to opt out.

How can I withdraw my consent?

If you change your mind after giving your consent, you can withdraw your consent to further collection, use or disclosure of your information at any time by contacting us at support@trixture.com.

Section 3 - Disclosure

We may pass on your personal data if we are required to do so by law or if you violate our terms of use.

Section 4 - Shopify

Our store is hosted at Shopify Inc. They provide us with the online e-commerce platform that enables us to sell our products and services to you.

Your information is stored in Shopify's data stores, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment gateway

If you choose a direct payment gateway to complete your purchase, Shopify stores your credit card information. They are encrypted according to the Payment Card Industry Data Security Standard (PCI-DSS). Your transaction data is only kept for as long as necessary to complete the purchase transaction. Your transaction data will then be deleted.

All direct payment gateways follow the standards of PCI-DSS, administered by the PCI Security Standards Council, a joint initiative of brands such as Visa, MasterCard, American Express and Discover.

The PCI-DSS requirements contribute to the secure handling of credit card information in our store and with our service providers.

Section 5 - Third Party Services

In general, the third-party vendors we use will only collect, use and disclose your information to the extent necessary to provide the services they provide to us.

However, certain third parties, such as certain payment gateways and other payment processors, have their own privacy policies regarding the information we are required to provide to them for your purchase-related transactions.

We encourage you to read the privacy policies of these suppliers so that you can understand how your personal information will be treated by these suppliers.

In particular, you should remember that certain suppliers may be located or have facilities in a different country than you or us. Thus, if you choose to proceed with a transaction involving the services of a third-party provider, your information may be subject to the laws of the country in which that provider or its facilities are located.

For example, if you are a resident of Canada and your transaction is processed through a payment gateway in the United States, your personal information used to complete the transaction may be subject to disclosure under United States law, including the Patriot Act.

When you leave our store's website or are redirected to a third-party website or application, you are no longer bound by this privacy policy or our website's terms of use.

To protect your personal information, we take reasonable precautions and follow industry best practices to ensure that it is not lost, misused, altered, disclosed or destroyed.

When you provide us with your credit card information, the information is encrypted using Secure Socket Layer (SSL) technology and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and other recognized industry practices.

You expressly agree that your use of the Service, or inability to use the Service, is at your own risk. The Service and all products and services provided through the Service are provided to you "as is" and "as available" for your use, without any warranties, representations or conditions, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, ownership and non-infringement.

In no event will Trixture, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any damages, including but not limited to lost profits, lost revenue, lost savings, loss of data, or other similar damages arising out of your use of the service or any product obtained through the service.

Section 14 - Indemnification

You agree to indemnify Trixture and our parent company, subsidiaries, affiliates, partners, managers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claims or demands, including reasonable legal fees, from third parties due to your violation of these Terms of Use or your violation of any law or the rights of a third party.

Section 15 - Severance

If any provision of these Terms of Use is held to be unlawful, void or unenforceable, such provision shall nevertheless be enforced to the fullest extent possible in accordance with applicable law, and the invalid portion shall be deemed severed from these Terms of Use; such decision shall have no effect on the validity and enforceability of the remaining provisions.

Section 16 - The Price

During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates.

Notwithstanding the previous paragraph, the operator may offer products or services with variable prices that are subject to fluctuations in the financial market and over which the operator has no influence. This liability for price fluctuations and the fact that the stated prices are guide prices will be explicitly mentioned in the offer.

Price increases within three months after the conclusion of the contract are only permitted if they are due to legal regulations or provisions.

Price increases from three months after the conclusion of the contract are only allowed if the operator has agreed to them and:

  1. they result from legal regulations or provisions; or
  2. the consumer has the right to terminate the contract with effect from the day on which the price increase takes effect.

According to Article 5, Paragraph 1 of the 1968 VAT Act, the place of delivery is the country where transportation begins. In this case, the delivery takes place outside the EU. Subsequently, the postal or courier service will collect the import VAT and/or customs clearance costs from the customer. Therefore, the operator does not charge VAT.

All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors. In the event of printing and typographical errors, the operator is not obliged to supply the product at the incorrect price.

Section 17 - CESOP

Due to the measures introduced and tightened in 2024 regarding the "Amendment of the 1968 VAT Act (Implementation of the Payment Service Provider Directive Act)" and the resulting introduction of the Central Electronic Payment Information System (CESOP), payment service providers may register data in the European CESOP system.

These Terms of Use and any separate agreements under which we provide services to you shall be governed by and construed in accordance with the law.

We reserve the right to update, change or replace any part of these Terms of Use at our sole discretion by posting updates and changes on our website. It is your responsibility to check our website regularly for changes. Your continued use of our Site or Service after changes to these Terms of Use are posted will be deemed your acceptance of such changes.
